A legal action could be either a criminal case or a civil case. There are two sides in every legal action. The legal progression starts when a filing occurs. The plaintiff is the one who is accusing or alleging. The defendant is the accused and the party who is repudiating the plaintiff’s charges, be it civil or criminal.
Lawyers represent each side. A prosecutor represents the plaintiff and a defense attorney represents the defendant. The case starts when a pleading has been filed. A pleading is notice of intent to file a charge. Both sides share their findings in a process called discovery. In the discovery process, attorneys will lay out the foundation of their case.
The trial is the next stage. Trials may be a jury trial or a bench trial, where a judge determines outcome. There are variations in law in each state, so regulations and laws may vary depending on where the trial is to be held. Some trials must be trials of juries.
Throughout the trial, both sides present their case after giving opening statements. The plaintiff typically goes first. Each side’s attorney has the right to interrogate the witnesses that the other side called to appear. These opening statements tell the judge and jury what their intent is and what to expect from there evidence and witnesses. When both sides of the case are done, the case goes to the jury. A judge gives instructions to the jury; then the jury is dismissed to deliberate. They deliberate until they reach a decision, at which time, they advise the judge. The court is called into session where the verdict is read. After the jury’s verdict is read, the defendant will be found innocent, guilty, or the case will be dismissed if no verdict can be agreed upon.
Our legal system is a system of justice based on a three-tier structure. The trial would have started at the first tier courts. If either party doesn’t agree with the verdict, they can appeal. If there is an appeal the case goes to the Appellate Court aka Court of Appeals. There the arguments are heard. The appellate judges can determine if the verdict was wrong and change the verdict. They can send it back to be reheard. They can agree with the lower court verdict.
The Supreme Court has the final say in a case matter. Should the parties disagree with the Court of Appeals, they can appeal to the Supreme Court in their state.
